Title: Constitutions, Courts and History Historical Narratives in Constitutional Adjudication
Authors: Uitz, Renáta
Keywords: Constitutions
Issue Date: 2005
Publisher: Central European University Press
Description: Intuitively, at least for lawyers, the record book of history appears as a treasury of very sound points of reference. Precisely due to this reputation, constitutional review fora have a tendency to rely on references to history and traditions (historical narratives) in order to clarify or supplement constitutional provisions, to determine their proper scope of application, and sometimes even to substitute constitutional provisions. Prima facie, historical narratives look like the ultimate tools of taming indeterminacy in constitutional interpretation
